Welcome to Jiya Chikan (“Company,” “we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your access to and use of our website, products, and services. By visiting our site or purchasing from us, you agree to be bound by these Terms. If you do not accept them, please refrain from using our services.

1. Definitions

  • “Site” – www.jiyachikan.com and all sub-domains.
  • “Customer/You” – any person browsing, buying, or otherwise interacting with the Site.
  • “Products” – all goods listed or sold by Jiya Chikan, including ready-to-wear and custom chikan apparel.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to place an order. By using the Site, you represent that you meet this requirement.

3. Account & Accuracy

You may browse without an account, but certain features (e.g., order history, wish-lists) require registration. You agree to provide accurate, current, and complete information and to update it as needed.

4. Products & Descriptions

We strive for precise colors and descriptions, but slight variations in embroidery, shade, or sizing can occur due to the hand-crafted nature of chikan work and screen settings. Such minor differences do not constitute defects.

5. Pricing & Payment

  • Prices are quoted in Indian Rupees (INR) and include applicable GST unless stated otherwise.
  • We reserve the right to change prices or launch promotions at any time.
  • Accepted payment methods are listed at checkout. By submitting a payment, you warrant that you are authorized to use the chosen method.
  • Orders are confirmed only after full payment is received and you receive an order-confirmation email.

6. Shipping & Delivery

  • Estimated dispatch and transit times are displayed at checkout; these are approximate and may vary due to courier delays or force majeure.
  • Title to the Products and risk of loss pass to you upon hand-over to the carrier.
  • Duties or taxes outside India are the customer’s responsibility.

7. Exchange & Returns

Our Returns & Exchange Policy, incorporated by reference, is available on the Site. Key points:

  • Exchanges accepted within 7 days of purchase; customer ships items to our Lucknow warehouse.
  • Customized items are not eligible for exchange.
  • Returns allowed only for damaged or incorrect items, subject to verification (unboxing video mandatory for orders > ₹5,000).
  • Approved exchanges are compensated via store-credit coupon; approved returns receive a full refund to the original payment source (or bank transfer if unavailable).

8. Coupons, Gift Cards & Promotions

Coupons are single-use, non-transferable, and cannot be combined unless the promotion expressly allows it. Each promotion is governed by its specific rules; in case of conflict, those rules prevail over these Terms.

9. Intellectual Property

All content on the Site—including designs, logos, photos, text, and graphics—is the property of Jiya Chikan or its licensors and is protected by Indian and international IP laws. Reproduction or redistribution without written consent is prohibited.

10. User Conduct

You agree not to:

  1. Use the Site for illegal or unauthorized purposes.
  2. Upload or transmit viruses, spam, or harmful code.
  3. Attempt to gain unauthorized access to servers or data.
  4. Post defamatory, obscene, or infringing material.

11. Disclaimer of Warranties

Except as expressly stated, Products and services are provided “as is” and “as available.” We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the fullest extent permitted by law, Jiya Chikan shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Site or Products, even if advised of the possibility. Our total liability for any claim shall not exceed the amount you paid for the Product giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless Jiya Chikan, its directors, employees, and affiliates from any claim or demand arising out of your breach of these Terms or your violation of any law or third-party right.

14. Force Majeure

We are not liable for failure to perform any obligation where the failure results from events beyond our reasonable control, including acts of God, natural disasters, strikes, or governmental actions.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of the courts at Lucknow, Uttar Pradesh.

16. Changes to Terms

We may update these Terms from time to time. The “Last updated” date will change accordingly. Continued use of the Site after changes constitutes acceptance.
